Back in November, photographer Kevin Sites videotaped a Marine firing an insurance shot into an enemy combatant during a sweep of a Fallujah
garrison armory mosque. The military has declined to bring formal charges against the Marine:
WASHINGTON (Reuters) - Military investigators have decided there is not enough evidence to bring formal charges against a Marine who killed an unarmed Iraqi while his unit searched a Fallujah mosque, CBS reported on Wednesday.

"The insurgents, it turned out, were unarmed," CBS reported. "But investigators say the Iraqi the Marine thought he saw moving could have been going for a weapon."
The report is from al-Reuters, which relies on quotes and statements from CBS, so take that for what it's worth in terms of the obvious editorializing. As I said in my original post about this linked above, our soldiers deserve the benefit of the doubt in situations like that. They've certainly earned it. (Link via Ace of Spades.)
